CONDITIONS OF SALE

These General Terms and Conditions of Contract (hereinafter, General Terms and Conditions) regulate the process of buying and selling the products offered by

The General Terms and Conditions bind NRI: 03/042670 and the buyer (customer), granting them a series of rights and obligations, from the moment the latter places and accepts an order through the aforementioned page. They are mandatory and known by both parties, so their acceptance is essential to be able to formalize an order. Therefore, the Client must read these conditions carefully. The headings of the different clauses are for information purposes only, and will not affect, qualify or extend the interpretation of the General Conditions. These General Conditions will be regulated by the provisions of current legal regulations. 

1. INTERVENING PARTIES: SELLING COMPANY, owner of the SocksandCo brand. is MARSALA DESIGN SLU, a company registered in the Mercantile Registry of Alicante, Volume 4052, Folio 54, Page A-156044, Inscription 1, with C.I.F. B42518860 and registered office at C/ Benlliure, n 29,03450, Banyeres de Mariola (ALICANTE), owner of page socksandco.com  and its subdomains or pages affiliated to that domain. CUSTOMER, any user of the website socksandco.com who places an order and accepts it at the time of placing it will be considered a customer. The customer must register as such and provide the following information in order to place the order: name and surname or company name, invoice address, delivery address, contact telephone number and contact email.

2. OBJECT OF THE CONTRACT:  Purchase by the customer of products included in the website: socksandco.com

3. OFFER PROCESS: The offer of the products can be considered to be all those that are related and appear on the website.  socksandco.com

Each product has information detailing, among other concepts, a description of the product and the retail price including VAT.

Prices are correct except for typographical errors or computer failures.

Shipping costs are detailed at the time of purchase and may vary depending on the urgency of the service requested. The price of the products will be the one that appears on the website at the time of placing the order.

4. ACCEPTANCE OF THE OFFER: It occurs at the time when the customer gives their express consent to the order placed, and after the acceptance of the General Conditions. It materializes when you accept these and finish the purchase process.

5. PAYMENT OF ORDERS:

By credit card, where only Visa and Mastercard cards protected by Verified Visa are accepted. If the customer's card is not registered by Verified, the customer should check with their bank or savings bank to register it. 

2. Payment via PayPal. The system will automatically calculate the shipping costs and these total prices will be communicated before the Customer's acceptance of the order.

6. ORDER DELIVERY: Order delivery times depend on the availability of the product or products that make them up. However, this availability period may be modified in the event of simultaneous orders for the same product or products that lead to the end of the product's stock. The new delivery time will be indicated to the customer in the shortest possible time. If the end of stock is definitive, the customer will be notified to choose between choosing a different product or cancelling their order. Delivery will be made to the delivery address indicated in the shipping details of the order. The subsequent modification of this address may generate a series of expenses that would be borne by the client. Orders will be delivered by a transport company to the delivery address indicated by the customer and to the person who has been set as the recipient of the orders. This data will be recorded on the delivery note of the transport company. If at the time of delivery it is visibly and clearly noticed, without the need to manipulate the shipping packaging or the product's own packaging, that a product has defects caused by damage in transport or an error is seen, in the same way, in the goods received, the customer must state this on the delivery note and notify SocksandCo. by email or web chat within 24 hours of receiving the order in order to be able to request the return of the affected product(s) and thus the replacement with a new one or the refund of the price paid for it. The customer may request an invoice using the same contact form.

7. RIGHT OF WITHDRAWAL: The customer is recognised as having the right to withdraw from the order within seven working days from receipt of the order, as stated in Article 44 of Law 7/1996, of 15 January, on the Regulation of Retail Trade. Outside this period, order revocations will not be accepted. The customer may be required to withdraw from the order, to bear the direct cost of returning the product to SocksandCo. When the customer has exercised the right of withdrawal or the right of termination, SocksandCo. You will be obliged to refund the sums paid by the customer, less the shipping costs. The refund of these sums will be made as soon as possible and, in any case, within a maximum period of thirty days from the withdrawal or resolution. The Client must notify SocksandCo of his/her withdrawal. through the corresponding contact form, within the established period. In this way, the customer can be informed of the order return procedure (return number, shipping method and delivery address).

8. OBLIGATIONS OF THE CUSTOMER: Read these General Conditions prior to accepting the order. Respect the General Conditions once the order has been accepted. Pay the prices agreed upon at the time of placing the order.

9. OBLIGATIONS OF SocksandCo.: From SocksandCo. We promise to deliver the product in optimal conditions at  the fixed shipping location. Respect the price of the orders agreed at the time of placing them.

10. CUSTOMER RIGHTS: To receive the products that make up your order in perfect condition. Cancel the order before it is shipped using the contact form, email to info@socksandco.com or in the web chat.

11. SOCKSANDCO'S RIGHTS: To receive payment for orders. Modify the prices established on your website for your products. Modify product delivery times depending on product availability. Cancel orders due to customer non-payment. Cancel the website without prior notice.

12. NOTIFICATIONS: For the purposes of notifications, requirements and writings of any kind to which this contract gives rise, Socksandco's address shall be understood to be the one indicated in these General Conditions.

13. VALIDITY OF THE CLAUSES: Even if a clause of this agreement or of one of its parts is declared invalid or unenforceable, the rest of the clauses or parts thereof shall continue to be valid and valid.

14. APPLICABLE REGULATIONS: These General Conditions are governed by current Spanish regulations, and specifically by: Civil Code, Law 26/84 of 19 June General for the Defence of Consumers and Users, Law 7/98 of 13 April on General Contracting Conditions, Law 7/96 of 15 January on the Regulation of Retail Trade, Directive 2000/31 EC of the European Parliament and of the Council of 8 June, Law 34/2002 of 11 July on Information Society Services and Electronic Commerce, Law 23/2003 of 10 July on Guarantees in the Sale of Consumer Goods and the regulations that develop them. The parties, expressly waiving their own jurisdiction, accept Spanish law as the governing law of this contract and submit to the courts and tribunals of Alcoy for the resolution of any disputes that may arise from it.

Suppliers or issuers of means of payment may adopt anti-fraud measures that lead to the rejection of certain types of transactions. The company is not responsible for the application of such security policies.

At the end of the order, you will receive a confirmation in the email provided, confirming that the process has been completed. If you do not receive communication, please contact us.

PRICE: The prices of the products that  are detailed include VAT (Value Added Tax),  as appropriate, discounts, rebates... The price can vary according to the VAT established by law.

-WARRANTY OF THE PRODUCTS PURCHASED:  The guarantee offered is that established in Royal Legislative Decree 1/2007, of 16 November, which approves the revised text of the General Law for the Defence of Consumers and Users. The company will be liable for any lack of conformity that manifests itself within two years of delivery.

The Customer Service will attend and respond to your complaint as soon as possible, and in any case within a maximum period of one month.

-MODIFICATION OF THE GENERAL CONDITIONS OF PURCHASE.

The company reserves the right to modify these General Terms and Conditions of Purchase at any time. No changes will affect orders that are already in progress.

- FORCE MAJEURE.  The company's compliance with all or part of its obligations will be suspended in the event of an unforeseeable event or force majeure that prevents or delays compliance. The following shall be considered as such, in particular, but not limited to this list: war, mutinies, insurrection, social disturbances, strikes of any nature and supply problems not attributable to the enterprise. The company will inform the client of such an act of God or force majeure within seven days after its occurrence. In the event that this suspension lasts beyond a period of fifteen days, the customer will then have the possibility of cancelling the order in progress and will then be refunded under the conditions set out in point 6 of these General Terms and Conditions of Purchase.

APPLICABLE LAW AND JURISDICTION: These General Terms and Conditions of Purchase are subject to Spanish law. Without prejudice to the above, the consumer who is not resident in Spain also enjoys the protection guaranteed by the mandatory provisions of the law of the country where he or she has his or her habitual residence. The parties submit, at their option, for the resolution of conflicts and waiving any other jurisdiction, to the courts and tribunals of the client's domicile.

Parcel Shipping

Our shipments are made through Correos and Ontime with deliveries ranging from 14 hours to 8 days. Shipments to Europe are made with UPS and transit depends on the destination location.

The calculation of the shipping costs is done in the cart before finalizing the purchase. 

All our shipments are free with non-urgent postal transport for shipments in mainland Spain, for shipments over 18€. Free express transport is available from € 24

You can choose to pick up at a post office or at Citypack mailboxes if you are not normally at the delivery address.

Our urgent shipments are shipped the same working day if the order is placed before 12:00 p.m. and the day after if they are made with Correos.

In Christmas and Three Kings periods, these periods can be longer.

The order will be sent to the address indicated by the customer. It is important that all the data is correct, especially the postal code, telephone number and town.

Any absence or error in the data entered may alter the preparation and transit time of the shipment.

Remember to include complete details, a mobile phone number and a contact email, as well as any indication about delivery.

The stipulated time for deliveries indicated in the detail of each shipping method is informative and will vary depending on the service chosen. Transit times are those indicated by the carriers, but may vary depending on the time of year. If you need your order by a date and would not be interested in receiving it if it is delayed, please contact us. 

Our carriers do not deliver on weekends or holidays and transit time is calculated in working days. The delivery of the package cannot be made at a certain time or time, but a link to the order tracking can be consulted in the account. If you can't find it, you can contact us and we'll inform you as soon as possible.

In case of absence in delivery:

Correos: Deposit the shipment for 7 days at the nearest office. A second delivery may occasionally be made.

Ontime: Make a second delivery the next business day.

Oops: Drop off the shipment for 4 days at the nearest UPS pickup point.

 

In the event that the transport cannot deliver the order and it is returned to our warehouse due to absence or not picking up on time, the customer must pay the shipping cost again in order to receive their order. If the order has been returned to our warehouse and its return is requested, the shipping and return shipping costs will be deducted.

 

Exchanges and returns.

We do not currently offer free shipping on exchanges or returns.

If you have made a mistake in the size or change your mind, you can come to one of our stores or contact us within 30 calendar days, so that we can process the return or exchange.

If your product is personalized, you will not be able to make exchanges or returns. If you have any questions, first contact our design department to clarify any questions about customization.

All products must retain the original packaging and the customer will be in charge of the shipment. Once received and checked, the amount of the same will be refunded minus the cost of transport. We are not responsible for the loss of the items during their return.

You can make exchanges and returns in our physical stores in Valencia and Alcoi - Alicante.
